A Query on Celebrating and Congratulating Non Islamic Festivals

Soalan:
Assalaamu 'alaikum Ustaz,
Saya nak tanya, betul ke kita tidak boleh ikut serta perayaan bukan Islam, misalnya ucap "Merry Christmas". Apakah ini perkara perselisihan pendapat, misalnya Madzhab Syafi'ie atau Maliki beza pendapat?
(Tolong jawab dalam English, supaya mudah saya terangkan pada yang lain).

Wa 'alaikumussalaam wa rahmatullaah wa barakaatuh, 
Bismillaah walhamdulillaah was solaatu was salaam ‘alaa Rasuulillaah wa ‘alaa aalihi wa sohbihi wa man waalaah.
Ammaa ba'd,

Terlebih dahulu, saya memohon maaf kerana lambat jawab soalan Tuan (28hb Disember). 
Berikut ini penjelasan 'Ulama mengenai perkara yang ditanyakan:

Allaah the Exalted and Most High says (translation):

“And those who do not witness falsehood, and if they pass by some evil play or evil talk, they pass it by with dignity” [al-Furqaan 25:72]. 

The scholars interpreted "az-Zour - falsehood" in this aayah as referring to the festivals of the mushrikeen. So the meaning of the aayah, this sacred verse of the Qur'an is: "And those who do not witness or attend the festivals of the mushrikeen"

Tafseer at-Tabari (d. 310H/923CE): 17/522

Ibn Bashshaar narrated (with it's chain of narration) that ad-Dhohhaak interpreted this verse, he said: it is "as-Shirk" associating others as Gods other than Allah.

Younus narrated (with it's chain of narration): Ibn Zayd said: "az-Zour" is whatever they do for their Idols and their respect and honour for them (the false gods)

[al-Imam at-Tabari; Muhammad ibn Jareer al-Tabari was born in 224H and died in 310H, at the age of eighty-six. Ibn Khuzaymah (223-301H) said: I have read it from beginning to end and I do not know of anyone on the face of the earth who is more knowledgeable than Ibn Jareer - Siyar A’laam al-Nubala’, 14/273.] 


Tafseer Ibn Katseer: 10/331:
Abul 'Aaliyah, Thowous, Muhammad bin Siereen, ad-Dhohhaak, ar-Rabie' bin Anas and many others said: (az-Zour) is the festivals of the Mushrikeen.

[al-Imam Ibn Katseer; Abu’l-Fida’ Ismaa’eel ibn Katheer al-Dimashqi, d. 774H (1372 AD/CE). Al-Suyooti (died 911H -  may Allaah have mercy on him) said concerning this Tafseer: Nothing like it has ever been written. Tadhkirat al-Huffaaz, p. 534.]

Ibn al-Qayyim (died 751H/1350CE) in Ahkam Ahl al-Dhimma (vol. 1, p. 205) writes, "Giving congratulations on the special events that are specific to the disbelievers, such as congratulating them on their holidays by saying, "Blessed holiday for you" or other similar greetings, is considered forbidden by the agreement of the scholars. Even if the one who states it is free from any aspect of apostasy, it is still a forbidden act and it is the same as congratulating them upon their prostrations to the crucifix. In fact, that is one of the greatest sins in Allah's (Subhaanu wa ta'ala) sight. That is a greater sin than congratulating them for drinking wine, having illegal sexual intercourse and so on. Many of them who are not very religious do such things and they do not know how evil what they are doing really is. Whoever congratulates another human for any sin, heresy, or act of apostasy has exposed himself to the punishment and anger of Allah (Subhaanu wa ta'ala). The pious people from the early scholars would avoid congratulating the oppressors when they received positions of authority or the ignorant when they were given judicial or teaching positions in order to avoid the punishment of Allah (Subhaanu wa ta'ala) and falling from His Grace. If a person would be compelled to go to such people to repel any evil that he expected from him, only to speak well to him and to ask Allah (Subhaanu wa ta'ala) to guide him, there is nothing wrong with that." 


قال الزيلعي في "تبيين الحقائق" (حنفي) (6/228) : " ( والإعطاء باسم النيروز والمهرجان لا يجوز ) أي الهدايا باسم هذين اليومين حرام بل كفر , وقال أبو حفص الكبير رحمه الله لو أن رجلا عبد الله خمسين سنة ثم جاء يوم النيروز , وأهدى لبعض المشركين بيضة ، يريد به تعظيم ذلك اليوم ، فقد كفر , وحبط عمله . وقال صاحب الجامع الأصغر : إذا أهدى يوم النيروز إلى مسلم آخر , ولم يرد به التعظيم لذلك اليوم , ولكن ما اعتاده بعض الناس لا يكفر , ولكن ينبغي له أن لا يفعل ذلك في ذلك اليوم خاصة , ويفعله قبله أو بعده ، كي لا يكون تشبها بأولئك القوم , وقد قال رسول الله صلى الله عليه وسلم { من تشبه بقوم فهو منهم } . وقال في الجامع الأصغر رجل اشترى يوم النيروز شيئا ، لم يكن يشتريه قبل ذلك ، إن أراد به تعظيم ذلك اليوم كما يعظمه المشركون كفر , وإن أراد الأكل والشرب 
والتنعم لا يكفر " انتهى .

Al-Zayla’i (al-Hanafi) said in Tabyeen al-Haqaa’iq (6/228): Giving gifts on the occasion of Nayrooz and Mahrjaan [two non-Islamic Persian festivals] is not permissible, i.e., giving gifts on these two days is haraam, and is in fact kufr. Abu Hafs al-Kabeer (may Allaah have mercy on him) said: If a man were to worship Allaah for fifty years, then on the day of Nayrooz he were to give an egg as a gift to one of the mushrikeen, intending thereby to venerate that day, he would have committed kufr and his good deeds would be cancelled out. The author of al-Jaami’ al-Asghar said: If he gives a gift to another Muslim on the day of Nayrooz, not intending thereby to venerate that day, but it is the habit of some people to give gifts on that day, then this is not regarded as kufr. But he should not do it on that particular day; he should do it before or after, so that he will not be imitating those people. The Messenger of Allaah (peace and blessings of Allaah be upon him) said: “Whoever imitates a people is one of them.” It says in al-Jaami’ al-Asghar: A man bought something on the day of Nayrooz which he did not buy before that. If he intended thereby to venerate that day as the mushrikoon venerate it, then he has committed kufr, but if he wanted to eat or drink or enjoy himself, then he has not committed kufr. End quote.


If it is said that, this is the statement of Hanafi, Shafi'ee and Hambali scholars. I am a follower of Maliki.



Then these are statements from not only Maliki's scholars but other scholars too: 

وقال في "التاج والإكليل" (مالكي) (4/319) : " وكره ابن القاسم أن يهدي للنصراني في عيده مكافأة له ، ونحوه إعطاء اليهودي ورق النخيل لعيده " انتهى .

It says in al-Taaj wa’l-Ikleel (a Maaliki book – 4/319): Ibn al-Qaasim regarded it as makrooh to give a gift to a Christian on the occasion of his festival, or to give palm leaves to a Jew on his festivals. End quote. 

وقال في "الإقناع" من كتب الحنابلة : " ويحرم شهود عيد اليهود والنصارى وبيعه لهم فيه ، ومهاداتهم لعيدهم " انتهى .

It says in al-Iqnaa’, which is a Hanbali book: It is haraam to attend the festivals of the Jews and Christians and to sell them things or give them gifts on the occasion of their festivals. 

Tafseer al-Qurtubi, authored by al-Qurtubi (died: 671H): 15/484:



"Allah the Most High says:  
And those who do not witness falsehood, and if they pass by some evil play or evil talk, they pass it by with dignity” [al-Furqaan 25:72].
There are 2 issues (to be discussed)
First: Allah's the Exalted saying: “And those who do not witness falsehood,..." meaning: They do not attend to deceit/lies, falsehood and they do not witness (or be present at the place of such evil things). az-Zour is anything of Falsehood which is manipulated and beautified (attractive and enticing) and the foremost of them is Shirk and Glorifying Idols and this is the interpretation of ad-Dhohhaak, Ibn Zayd and Ibn 'Abbaas.

In another narration from Ibn 'Abbaas (the cousin and companion of the Messenger of Allah, died 68H): it is the festivals of the Mushrikeen (Disbelievers or Non-Muslims). ..." (end quote)

Semoga kini jelas kepada Tuan "Abang Jempol" dan diharapkan begitu juga kaum Muslimin yang lain, yang pada mulanya mungkin tidak mengetahui atau tidak jelas mengenai larangan yang berat ini.
Ada banyak lagi dalil-dalilnya dan seingat saya, ada beberapa yang boleh didapatkan daripada berbagai website English.

Islam agama untuk seluruh umat manusia dan umat manusia yang Islam, sandaran agamanya adalah al-Qur'an, as-Sunnah dan penjelasan 'ulama dan yang utama sekali, para Sahabat seperti Ibn 'Abbaas.

Sebagaimana seringkali disebutkan dalam khutbah Jumaat, dengan diambil ayat daripada Surah al-Anbiyaa', bahawa Rasulullah diutuskan sebagai Rahmat seluruh Alam dan antara Rahmat terbesar adalah dengan manusia tidak mensyirikkan Allah dan mentauhidkanNya dan itulah Ajaran Utama Rasulullaah yang mengajarkan Tauhid menghindari segala Syirik, seumpama mengucapkan "Selamat anda menyambut Hari Kelahiran Anak Allah" saya tidak sambut, kerana ucapan itu adalah membenarkan dan merestui Syirik yang mereka lakukan.

Di Singapura ini, kita tidak perlu pula, malah terlarang dalam ajaran agama Islam, mengutuk dan mencela sembahan-sembahan selain Allah. Atau mencerca mereka atas perayaan mereka, baik di belakang mereka (dengan berbisik-bisik) apatah lagi di hadapan mereka secara terang-terangan. Itu ekstrim, pelampauan yang mencanggahi ayat Allah:

Surah al-An'aam ayat 108:

"And insult not those whom they (disbelievers) worship besides Allah, lest they insult Allah wrongfully without knowledge. Thus We have made fair-seeming to each people it's own doings; then to their Lord is their return and He shall then inform them of all that they used to do."

Dalam pada masa yang sama, kita juga tidak boleh menjadi ekstrim mencanggahi ayat-ayat Allah dan ajaran Islam umumnya yang melarang kita menyetujui Kufur dan Syirik kerana ia perkara paling dibenci Allah dan RasulNya, seperti dalam penjelasan tadi.
Sehinggakan, jika mereka beri kita hadiah yang halal pada Hari Kebesaran mereka, tiada salahnya kita menerimanya, menurut pendapat yang lebih kuat. Tetapi sebaliknya terlarang untuk kita berikan hadiah kepada mereka sempena Hari Kebesaran mereka. sila lihat:

Usahlah kita jadi golongan pelampau atau ekstrim, kemudian kita menuduh pihak lain yang benar-benar mengikut ajaran Islam yang tulen asli dan benar (bersesuaian al-Quran dan as-Sunnah dan menuruti 'Ulama terunggul) sebagai "ekstirm".  Ingatlah, "1 jari menuding ke orang lain, 3 jari menuding ke diri sendiri".

Sama-samalah kita teliti dengan mendalam, hadis Rasulullah berikut ini:
"إن الله تعالى لا يقبض العلم انتزاعا ينتزعه من العباد (الناس) و لكن يقبض العلم بقبض العلماء ، فإذا لم يُبْقِ عالما اتخذ الناس رؤساء جُهَّالاً، فسئلوا فأفتوا بغير علم فَضَلُّوا و أَضَلُّوا"
Ertinya: Sesungguhnya Allah Ta‘ala tidak mencabut ilmu dari umat manusia dengan merentapnya (misalnya, orang alim tiba-tiba kehilangan ilmu). Tetapi, Allah mencabut ilmu dengan mencabut (nyawa) ‘ulama’ (yang benar-benar ‘alim). Maka apabila telah tiada ‘alim sebenar yang hidup, manusia mengambil orang-orang jahil sebagai ketua-ketua. Mereka (ketua-ketua jahil itu) ditanya, maka mereka memberi fatwa tanpa ilmu. Mereka itu sesat lagi menyesatkan.

Dulu di India, ada seorang yang terkenal sebagai 'Alim, yang ditabalkan sebagai 'Alim daripada 'Ulama Islam oleh pihak East INDIA Company dan orang-orang Islam yang JAHIL pun mempercayainya iaitu Mirza Ghulam Ahmad, pengasas Ahmadiah, lalu ia merubah ajaran Islam agar bersesuaian dengan segala kehendak pihak Berkuasanya, East India Company. Kita bermohon kepada Allah, agar menyelamatkan masyarakat kita daripada berulangnya sejarah dan terpelihara kita daripada penyelewengan seseorang yang seperti Ketua Ahmadiah ini, yang menggelarkan dirinya "Khalifah" malah Nabi dan al-Masih.
